Acceptance of terms

By accessing or using ShakeTheSpear (“Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms from time to time; we will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.

Privacy

Our Privacy Policy describes how we collect, use, and protect personal data, including cookies, AI processing, optional YouTube connections, and the optional browser extension. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

Account and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. We are not liable for losses from unauthorized access due to your failure to safeguard your credentials.

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to violate any law, infringe others’ rights, distribute malware, abuse or overload our systems, scrape or reverse engineer the Service except as allowed by law, or attempt to gain unauthorized access to any part of the Service or other accounts.

Your content

You retain ownership of content you submit to the Service. You grant us a limited license to use, store, and process your content as necessary to provide and improve the Service, including to send portions to AI providers when you use AI features. You represent that you have the rights to submit your content and that it does not violate any third-party rights or applicable law.

AI-generated content

The Service may include features that use artificial intelligence or machine learning. Output may be incorrect, incomplete, or unsuitable for your purpose. You are solely responsible for reviewing, editing, and deciding how to use any AI-assisted output, including for legal, financial, or public-facing decisions.

You must not use AI features in a way that violates applicable law, third-party rights, or our Acceptable use section.

Third-party services (including YouTube and Google)

The Service may interoperate with third-party platforms (for example YouTube and Google when you connect a channel or use related features). Those services are governed by their own terms and privacy policies. You are responsible for complying with them. We are not responsible for third-party services’ availability, accuracy, or practices.

Our intellectual property

The Service, including its design, features, and underlying technology, is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

Subscription, billing, and credits

The Service may offer paid plans, subscriptions, or usage-based credits. Fees, taxes, and renewal terms will be presented at purchase or in your account when billing is enabled. Unless stated otherwise, fees are billed in advance and are non-refundable except as required by law or as we expressly state.

We may use third-party payment processors; their processing of payment card data is subject to their terms and privacy notices.

We may change pricing or plans with reasonable notice where required by law. Continued use after a change may constitute acceptance. We may suspend or terminate access for non-payment.

Disclaimer of warranties

The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits. Our total liability for any claim arising out of these Terms or the Service is limited to the greater of the amount you paid us for the Service in the twelve months preceding the claim or fifty dollars (USD), except where liability cannot be limited by law.

Termination

We may suspend or terminate your account and access to the Service at any time for breach of these Terms or for other operational or legal reasons. You may terminate your account at any time through account settings or by contacting Support. Upon termination, your right to use the Service ceases; we may delete your data in accordance with our Privacy Policy and retention practices.

Governing law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, subject to mandatory consumer protections in your country of residence where they apply.

Browser extension

If you install our optional ShakeTheSpear Research browser extension, your use of it is governed by these Terms and our Privacy Policy. The extension interoperates with the Service and may display UI on third-party sites (such as YouTube). You are responsible for complying with applicable third-party terms when using those sites.
